GENERAL TERMS AND CONDITIONS OF CONTRACTING

These General Terms and Conditions of Contracting set out in this document apply to all commercial transactions carried out through the website: www.nuashop.com.

Sales made through this website constitute distance sales governed by applicable Spanish legislation. Validation of the order by the user or customer implies full and unreserved acceptance of these General Terms and Conditions of Sale. Any amendments made to these conditions shall apply to all purchases made after their publication on the website.
2. INTELLECTUAL AND INDUSTRIAL PROPERTY
All rights relating to industrial and intellectual property (including but not limited to trademarks, logos, texts, photographs, icons, images, graphic design, source code, and other software elements contained on the website www.nuashop.com) are owned by NUA BIOLOGICAL INNOVATIONS, S.L. or by the companies representing or manufacturing the products offered. They are therefore protected by Spanish and international intellectual and industrial property laws.
Without prior written authorisation from NUA BIOLOGICAL INNOVATIONS, S.L. or, where applicable, from the representative or manufacturer holding the rights, it is strictly prohibited to use, reproduce, transmit, manipulate, or perform any use beyond ordinary and necessary browsing of the website and utilisation of the services offered.
Access to the services provided does not imply, under any circumstances, a waiver, transfer, or assignment—whether total or partial—of rights derived from intellectual or industrial property. It does not grant any rights of use, alteration, exploitation, reproduction, distribution, or public communication without prior written consent from the relevant rights holders, without prejudice to the user’s right to view and obtain a private backup copy for personal use, provided such use adheres to good faith principles and preserves all intellectual and industrial property notices. The user shall be solely responsible for any improper use of protected materials.
3. PURPOSE AND ACTIVITY
NUA specialises in the marketing of food supplements.
The NUASHOP virtual store (www.nuashop.com) is a service made available by NUA for customers to consult and purchase, online, the products and/or services NUA offers, including delivery to the address provided.
The information on this website is purely informative and shall not be considered a substitute for medical prescription, diagnosis, or treatment. If you suffer from any illness or condition, we recommend consulting a healthcare professional. Products offered on this site are not medicines and are not intended to replace conventional medical treatment.
NUA is not responsible for information, comments, or content posted on this website or on linked sites (which serve merely informative purposes and shall not be considered treatment recommendations), nor for products mentioned on this site or their suitability. The User acknowledges that NUASHOP acts solely as an intermediary between the user and the manufacturer or distributor of such products and information. NUA recommends exercising caution with any information published on the website and consulting a healthcare professional when necessary.
NUA will make every effort to ensure that NUASHOP displays accurate information without typographical errors. If any such errors occur and the information does not correspond to the product characteristics and/or price, the registered User shall have the right to cancel the purchase without any cost, provided this is done in accordance with Section 8 of these General Conditions.
4. WEBSITE UPDATES
NUASHOP will display, at all times, the products available for sale together with their characteristics and prices—including VAT and any applicable taxes—organised by category. This presentation does not guarantee continuous availability, which depends on customer demand and the manufacturer’s or distributor’s stock.
NUA reserves the right to unilaterally review and update, at any time and without prior notice, the catalogue offered through NUASHOP, including modifications to products, prices, promotions, and conditions. NUA may change the presentation, characteristics, and/or price of products, remove items temporarily or permanently, or add new items, all of which shall be governed by the conditions in force at that time. Product images on NUASHOP may differ from the actual item. NUA guarantees the price applicable at the time the registered User completes the purchase.
NUASHOP strives to ensure that information on the website is accurate and free from typographical errors. Should such an error occur, it will be corrected immediately. If a customer completes a purchase based on such an error, NUASHOP will notify them immediately, and either party may cancel the purchase at no cost, provided the error is duly verified.
5. CONTRACTING PROCEDURE
The merchant undertakes not to allow any transaction considered illegal or harmful to the goodwill of credit card brands or acquiring banks.
To place an order, users must register as customers either at the beginning of their session or upon completing their order. Registering as a customer requires providing the necessary personal data to create an account. Fields marked with (*) are mandatory.
Upon registration, users will choose a username and password to identify themselves in future purchases. Users must safeguard this information and may not transfer it to third parties.
Registered customers must log in with their credentials to access their account.
In compliance with Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting process will follow these steps:
a. Select desired products.
Prices include VAT and are expressed in euros (€). Applicable prices are those displayed on the website and will be applied automatically at checkout. The user is solely responsible for selecting the product and determining its suitability for their intended use.
b. Add products to the virtual cart.
c. Review the order before finalising.
d. To continue shopping, select “Continue shopping.”
e. To complete the purchase, select “Confirm purchase.”
Upon completion, an email confirmation will be sent with all transaction details.
Product unavailability:
If a product is unavailable, this will be indicated on the website. If the user completes a purchase of an unavailable item, they will be notified within 48 hours. If the user objects, the paid amount will be refunded immediately.
6. DELIVERY CONDITIONS, TIMEFRAMES AND SHIPPING COSTS
Shipments will be made to mainland Spain, the Balearic Islands, and Andorra via express courier (24/48 hours, excluding weekends and holidays: RAMONEDA, SEUR).
At the customer’s request, shipments may also be sent via CORREOS (registered letter/parcel). Delivery time in this case may be longer (2–7 days).
Shipments to the rest of Europe* will be made via international courier with an estimated delivery time of 3–7 days.
No shipments are made to the Canary Islands, Ceuta, or Melilla.
Deliveries will be made during business hours, Monday to Friday, excluding holidays, to the address indicated by the customer and under recipient signature. The provider is not responsible for failed deliveries due to incorrect or incomplete user data or recipient-related issues (e.g., absence).
Shipping costs:
Mainland Spain: Free for orders over €40; €5 for orders under €40.
Balearic Islands: €3 for orders over €40; €8 for orders under €40.
Europe*: €12 in all cases.
*Applicable to European countries not excluded in the list above.
Shipping costs will be calculated automatically based on the delivery address.
7. PAYMENT METHODS
Four payment methods are available:

Credit/debit card via Redsys (BBVA Virtual POS)
Transactions are secure, encrypted via SSL, and processed over an HTTPS-secured server. -
Mobile payment via Bizum
Linked to the user’s bank account; authentication is carried out by the user’s bank. -
PayPal
A secure online payment service that enables electronic funds transfers without entering financial details for each transaction. -
Bank transfer to account ES73-0182-5745-56-02016-08264 (BBVA).
A payment receipt must be sent to contacto@nuabiological.com for the order to be processed.
8. RETURNS (Withdrawal Right), WARRANTIES AND CANCELLATIONS
If the customer is not satisfied with the order, they may return it within a minimum of 14 business days from delivery (per Law 7/1996, amended by Law 47/2002).
To exercise this right, customers are advised to contact the store by phone and submit a completed Withdrawal Form to contacto@nuabiological.com.
Products must be returned in their original condition and packaging. Damaged items due to improper packaging will not be accepted. Return shipping costs are borne by the user unless the return is due to a defective product.
Once the merchandise is received and inspected, NUA will issue the refund.
Defective or incorrect products will be replaced free of shipping charges within the first month from purchase.

Warranties
All products include the original manufacturer’s warranty. Customers must keep the purchase invoice.
Cancellation
Orders may be cancelled before they are fully processed or dispatched. If the order has already been shipped, it will be treated as a return.
9. PERSONAL DATA PROTECTION
In accordance with Organic Law 15/1999 on Personal Data Protection (LOPD), and related regulations, users are informed that data provided during purchase will be incorporated into the CLIENTES TIENDA VIRTUAL file owned by NUA BIOLOGICAL INNOVATIONS, S.L., for the purpose of maintaining commercial and contractual relations.
Users may exercise rights of access, rectification, opposition, and cancellation in accordance with the LOPD and Royal Decree 1720/2007 by written communication to NUA’s registered address.
Data will be processed exclusively for the indicated purposes and will not be disclosed to third parties except when necessary for service delivery.
Users may authorise NUA to send communications, newsletters, or promotional information by checking the appropriate boxes or contacting NUA via email. Consent may be revoked at any time.
NUA reserves the right to amend this Privacy Policy in accordance with applicable legislation.
10. APPLICABLE LAW
Commercial transactions with www.nuashop.com are governed by Spanish law.
Applicable regulations include:
– Law 34/2002 on Information Society Services and Electronic Commerce
– Law 7/1996 on Retail Commerce
Any disputes arising from interpretation or application of these Terms shall be submitted to the competent courts as established by applicable jurisdictional rules.
Where the purchaser resides outside Spain, both parties submit to the Courts and Tribunals of Vizcaya (Spain).
